1. WARRANTY COVERAGE

  1. Essilor Instruments USA (“EIUSA”) warrants that its ophthalmic and optical instruments will be free from defects in material and workmanship under normal use and service for a period of one (1) year beginning as follows:

    · For equipment requiring technical installation, the warranty period begins on the date of installation confirmed by EIUSA or its authorized service network.
    · For products that do not require technical installation, the warranty period begins on the date of delivery to the original purchaser.

During the warranty period, EIUSA will, at its sole discretion, repair or replace any product or component found to be defective. This is the exclusive warranty provided by EIUSA and supersedes all other express or implied warranties, including any implied warranties of merchantability or fitness for a particular purchase.

4. FIELD SERVICE COVERAGE

  1. If on-site service is required for a warranty issue:

    · Labor, parts and travel are covered when the defect is confirmed to be under warranty and within EIUSA’s standard service area.
    · If the location is outside standard coverage, travel charges may apply (airfare, lodging, mileage, per diem).
    · If no defect is found or the issue is determined to be non-warranty, the customer will be responsible for all labor, travel, and parts costs.
    · Work requested outside normal business hours is not covered under warranty and will be billed at quoted service rates.

5. SPARE PARTS COVERAGE

  1. Defective parts under warranty will be replaced at no cost.

6. LABOR AND TRAVEL COVERAGE

  1. EIUSA covers labor for verified warranty repairs performed by EIUSA or authorized service network.

7. FREIGHT AND SHIPPING COVERAGE

  1. For confirmed warranty repairs, EIUSA will cover standard ground freight both ways (customer to EIUSA and return).
  2. If expedited shipping is requested, EI will cover under warranty. The customer is responsible for the added cost, post warranty period.
  3. Freight claims for shipping damage must be reported within one (1) business day of delivery, and the original packaging must be retained for inspection.

8. LOANER EQUIPMENT

  1. The ROC (Rx Operations Cincinnati) presently manages (WAM) EI open box inventory that resides at the Cincinnati location.
  2. After thorough clean-up of the present inventory of product, these instruments will become future swap/purchase instruments to maintain maximum uptime for the stores.
  3. If an instrument fails under the warranty period and has been vetted by the EI technical support team to be unrepairable in the field, Luxottica will deploy a swap pool product from their inventory. If a pool instrument doesn’t exist, Luxottica will purchase from the open pool of equipment (including full new inventory warranty) and deploy the instrument immediately to replace defective instrument.
  4. The ROC would manage the asset change, notifying EI of the serial number swap.
  5. Detective units will be returned to an EI in-house service center for repair.
  6. After repair, the instrument will be placed in the Luxottica pool of inventory. If the product is still under warranty, there will be no charge for the service. If the product is found to be outside the warranty period, the service will be invoiced accordingly and sent to the ROC swap rotation.
  7. The Swap Pool will be reconciled between the ROC and EI at the end of each month to maintain inventory and serial number alignment

  1. EIUSA’s liability is limited exclusively to the repair or replacement of defective parts as provided under this policy.
  2. EIUSA shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of use, income, or data.
